This Seller Legal Notice ("Notice") constitutes a legally binding agreement between you ("Seller", "you") and Pukkade.com ("Pukkade", "we", "us", "our"). By registering, accessing, or using the Pukkade marketplace to list or sell products, you acknowledge that you have read, understood, and agree to be bound by this Notice in full. If you do not agree, you must not use our platform as a seller.

1. Seller Eligibility and Account
By creating a seller account, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into this agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, complete, and up-to-date information during registration and keep it current. Pukkade reserves the right to suspend or terminate accounts that provide false or misleading information.

2. Product Listings and Content
All listings must accurately describe the product, including its condition, specifications, pricing, availability, and any applicable terms of sale. You are solely responsible for all text, images, videos, and other content you upload. You warrant that you hold all necessary rights, licenses, and permissions for any content you submit, and you grant Pukkade a worldwide, non-exclusive, royalty-free license to host, display, and promote your listings on our platform and associated marketing channels. Listings must comply with our Prohibited Items Policy (Section 3) and applicable laws.

3. Prohibited Items and Conduct
You may not list or sell any item that:

• Is illegal, counterfeit, stolen, or infringes upon the intellectual property rights of others.
• Violates any applicable local, national, or international law or regulation.
• Is considered hazardous, dangerous, or restricted without proper authorization (e.g., weapons, pharmaceuticals, live animals, certain food items).
• Contains false, misleading, deceptive, or offensive content.
• Promotes hate speech, violence, or discrimination.
  Pukkade reserves the right to remove any listing or content at its sole discretion and to report illegal activity to the relevant authorities.

4. Fees and Payments
All fees, commissions, and payment terms are set out in our separate Fee Schedule or Seller Dashboard, which are incorporated by reference into this Notice. You agree to pay all applicable charges in connection with your sales on Pukkade. We may deduct fees from your sales proceeds before remitting payouts. It is your responsibility to report and remit any applicable taxes to the relevant tax authorities. Pukkade will issue payout-related tax documentation as required by law.

5. Shipping, Fulfillment, and Delivery
You are required to ship physical goods within the timeframe specified in your listing (or as otherwise agreed with the buyer) using a reliable, trackable shipping method. You must promptly upload valid tracking information where applicable. You bear the risk of loss or damage to goods until they are delivered to the buyer. For digital products, you must ensure that delivery is made securely and immediately upon completed payment.

6. Returns, Refunds, and Buyer Disputes
You must clearly state your return and refund policy in your listings, which must be at least as favorable as the minimum standard set by Pukkade (currently [specify minimum return window, e.g., 14 days], if any). You agree to process eligible returns and refunds promptly. Pukkade may, at its discretion, mediate buyer disputes, and its decisions shall be final if you have explicitly agreed to Pukkade's dispute resolution process. Failure to comply with a dispute decision may result in account restriction or termination.

7. Seller Representations and Warranties
You represent and warrant that:

• You have the legal right to sell each product you list.
• All products comply with applicable safety, labeling, and regulatory requirements.
• No product infringes on any third-party intellectual property, privacy, or publicity rights.
• You will fulfil every order as described, except in cases of genuine stock errors or where the buyer has been fully refunded.

8. Intellectual Property Rights
You retain ownership of your content and product images, subject to the license granted in Section 2. You may not use Pukkade’s name, logo, or trademarks without our prior written permission. If you believe another seller’s listing infringes on your intellectual property, please follow our IP Infringement Notice procedure (see Contact below).

9. Data Protection and Privacy
As a seller, you may receive access to personal data of buyers (e.g., names, addresses, contact details). You agree to process such data solely for the purpose of fulfilling the relevant order and in strict compliance with all applicable data protection and privacy laws. You must not retain, share, or use buyer personal data for any other purpose, including marketing, without the buyer’s express consent. Any breach of data protection obligations is grounds for immediate account termination and may result in legal action.

10. Liability and Indemnification
To the fullest extent permitted by law, Pukkade provides the marketplace “as is” and makes no warranties regarding uninterrupted access, sales volume, or success. Pukkade shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. You agree to indemnify, defend, and hold harmless Pukkade, its affiliates, and their respective officers, directors, and employees from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of this Notice, your listings, your products, or your violation of any law or third-party rights.

11. Termination and Suspension
We may suspend or terminate your seller account at any time, with or without notice, for any reason, including breach of this Notice, illegal conduct, or activities that may cause harm to Pukkade, buyers, or third parties. Upon termination, any outstanding obligations (such as unfulfilled orders, pending refunds, and fees) survive and remain enforceable. Pukkade will remit any undisputed balance in your seller account after deducting any amounts owed to us, subject to a reasonable holding period for buyer disputes.

12. Governing Law and Dispute Resolution
This Notice shall be governed by and construed in accordance with the laws of [Insert Jurisdiction, e.g., the country where Pukkade is registered]. Any dispute arising out of or in connection with this Notice shall first be attempted to be resolved through amicable negotiation. If negotiation fails, the dispute shall be resolved exclusively in the competent courts of [Insert Location], unless Pukkade opts for binding arbitration in accordance with the rules of [e.g., a recognized arbitration institution]. You waive any objection to venue and jurisdiction.

13. Amendments
Pukkade reserves the right to modify this Seller Legal Notice at any time. We will notify sellers of material changes via email or through the seller dashboard. Your continued use of the marketplace after such notice constitutes acceptance of the revised Notice. We encourage you to review this page periodically.
